1. Data Collection and Privacy

Location Data

• Clay does not permanently save your location data on our servers

• Location data is used temporarily during location-based activities (such as in-person time tracking) and is automatically deleted once the activity ends

• Saved locations are stored locally on your device only

• Saved locations are used to recommend the most appropriate activities for specific locations

Calendar Data

• Clay can sync with your Apple Calendar if you choose to enable this feature

• Calendar data is stored on our servers to provide scheduling and reminder functionality

• You can disable calendar syncing at any time in the app settings

• We only access calendar events that you explicitly choose to share with Clay

Health Data

• Clay may request Apple Health access for health-based activities

• Only health data generated within Clay activities is saved to our servers

• Existing health data from other sources is not accessed or stored by Clay

• You maintain full control over which health metrics Clay can access

2. Communication and Messaging

• In-app messages are currently not encrypted, though encryption is planned for future releases

• Do not share personal information, passwords, or sensitive account details through in-app messaging

• All communications are subject to our community guidelines and may be monitored for safety

3. User-Generated Content and Community Standards

Zero Tolerance Policy

Clay maintains a strict zero-tolerance policy for objectionable content and abusive behavior. By using Clay, you agree to conduct yourself in a respectful manner and to refrain from posting any content that violates our community standards. Violations will result in immediate action, including content removal, account suspension, or permanent ban.

User-Generated Content

• Users can create social posts from completed activities

• Users can upload photos to their posts

• Users can comment on posts from friends and other users

• Users can like and interact with content from other users

• All user-generated content is subject to moderation and must comply with these terms

Content Responsibilities

• You are solely responsible for all content you post, upload, or share on Clay

• You must ensure you have the right to share any photos, text, or other content you upload

• You must not impersonate others or misrepresent your identity

• All content is stored unencrypted on our servers and may be reviewed for moderation purposes

Strictly Prohibited Content

The following types of content are absolutely prohibited and will result in immediate removal and account action:

• Sexual or pornographic content of any kind

• Violence, gore, or content that promotes harm to oneself or others

• Harassment, bullying, or threatening behavior directed at any individual or group

• Hate speech or discriminatory content based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic

• Illegal activities or content that violates local, state, or federal laws

• Spam or repetitive content, including excessive friend requests or promotional material

• Child exploitation or endangerment in any form

• Privacy violations, including sharing others' personal information without consent

• Fraudulent content or attempts to deceive other users

• System abuse, including attempts to game, exploit, or manipulate the platform

Content Moderation

• All user-generated content is subject to review and moderation

• Clay employs both automated systems and human review to detect violations

• Content may be removed without notice if it violates these terms

• Repeat offenders will face escalating consequences up to permanent account termination

Reporting Objectionable Content

• Users must report any content that violates these terms using in-app reporting tools

• Reports are reviewed promptly, typically within 24-48 hours

• False or malicious reports may result in action against the reporting user

• Clay reserves the right to take action on unreported content that comes to our attention

Blocking Users

• Users can block other users to prevent unwanted interactions

• Blocked users will be automatically removed from your friends list

• Blocked users cannot view your profile, posts, or send you messages

• You will not see content from blocked users in your feed

• Blocking is reversible - you can unblock users at any time

• Clay is not responsible for interactions between users prior to blocking

4. Leaderboards and Rewards

Competition Structure

• Leaderboards are ranked by gems (points) accumulated through completed activities

• Free, Plus, and Pro users compete in separate tiers with different reward amounts

• Competitions run weekly with prizes awarded to top performers

• Users must participate for at least 3 days of the competition week to be eligible for rewards

Gift Card Rewards

• Clay rewards top users with gift cards from popular retailers

• Shipping addresses must be located in Canada or the United States

• Clay reserves the right to withhold rewards from users suspected of fraudulent activity or not located in the stated regions of CA or USA

• Prohibited activities include: gem farming, spam, system abuse, or any form of cheating

5. Goals and Content Creation

• Goals can be created manually or with AI assistance for automation

• Goals promoting gem farming, sexual content, violence, or illegal activities are prohibited

• Goals can be shared between users, subject to tier limitations

• Users on higher subscription tiers may have goal features limited when shared with lower-tier users

6. AI and Machine Learning Services

AI-Powered Features

Clay uses artificial intelligence and large language models (LLMs) to enhance user experience across various features. These AI services may occasionally provide inaccurate, incomplete, or inappropriate responses.

Features Using AI/LLM Technology

• Goal Creation: AI-assisted generation of personalized goals and action plans

• Food Tracking: Automatic food recognition and nutritional analysis from photos

• Photo Verification: AI analysis of activity completion photos for accuracy

• Audio Processing: Voice command recognition and audio content analysis

• Receipt Scanning: Optical character recognition and expense categorization in expense tracker

AI Accuracy and Limitations

• AI-generated content may contain errors, inaccuracies, or biased information

• Users should verify AI-provided information, especially for health, financial, or safety-related decisions

• Clay is not responsible for decisions made based solely on AI-generated recommendations

• AI models are continuously improving but may produce unexpected or inappropriate responses

• Users should report inaccurate or problematic AI responses through the feedback system

Data Processing for AI Services

• User-submitted content (photos, audio, text) may be processed by third-party AI services

• Data sent to AI services is processed according to their respective privacy policies

• Clay retains AI-generated results to improve service quality and user experience

• Users can opt out of certain AI features in app settings, though this may limit functionality

7. Subscription Tiers and Auto-Renewal

Available Tiers

Clay offers multiple subscription tiers (Free, Plus, Pro) each with specific feature limitations and benefits. Subscription details and pricing are available in the app's subscription section.

Auto-Renewable Subscriptions

• Plus and Pro subscriptions are auto-renewable and will automatically renew unless cancelled

• Subscriptions automatically renew at the end of each subscription period (monthly or yearly)

• Your account will be charged for renewal within 24 hours before the end of the current period

• The renewal charge will be the same price as the original subscription unless pricing changes are communicated to you in advance

• You can manage your subscription and turn off auto-renewal in your device's Account Settings after purchase

Cancellation Policy

• You may cancel your subscription at any time through your device's subscription settings

• Cancellation must be made at least 24 hours before the end of the current period to avoid being charged for the next period

• When you cancel, you will retain access to subscription features until the end of the current billing period

• No refunds will be provided for the unused portion of any subscription period

• To cancel: Go to Settings > [Your Name] > Subscriptions on your iOS device

Free Trial (If Applicable)

• Free trials, if offered, allow you to try subscription features before being charged

• You must cancel before the trial period ends to avoid being charged

• The full subscription price will be charged when the trial period expires unless cancelled

• Free trial availability and duration may vary and are subject to change

8. Enforcement and Consequences

Violation Consequences

Clay enforces these terms strictly to maintain a safe and positive community. Consequences for violations include:

• First Offense: Content removal and formal warning

• Second Offense: Temporary account suspension (7-30 days)

• Third Offense or Severe Violations: Permanent account termination

• Egregious Violations: Immediate permanent ban without warning (e.g., illegal content, child endangerment, severe harassment)

Investigation Process

• All reported content and behavior is investigated thoroughly

• Users may be temporarily restricted during investigations of serious allegations

• Clay reserves the right to involve law enforcement for illegal activities

• Decisions regarding account actions are final and at Clay's sole discretion

Appeals

• Users may appeal account actions through our support system

• Appeals are reviewed within 5-7 business days

• Clay's decision on appeals is final

• Multiple frivolous appeals may result in additional restrictions

9. Account Deletion

Users may delete their account at any time through the app's settings. Account deletion is permanent and irreversible. All user data, including profile information, goals, activities, social posts, and progress will be permanently deleted from our servers.

10. Account Termination by Clay

Clay reserves the right to immediately suspend or permanently terminate any account that violates these terms, engages in abusive behavior, posts objectionable content, participates in fraudulent activity, or compromises the safety and integrity of our platform and community. There is absolutely no tolerance for users who abuse our platform or harm other members of our community.

11. Changes to Terms

These terms may be updated periodically. Users will be notified of significant changes and must accept updated terms to continue using Clay.
